SMS Terms and Conditions

These SMS Terms and Conditions govern the text messaging programs operated by Mindful Wellness, referred to in these Terms as "Mindful Wellness," "we," "us," or "our."

By voluntarily opting in to receive text messages from Mindful Wellness, you agree to these SMS Terms and Conditions and our SMS Privacy Policy.

1. SMS Programs

Mindful Wellness offers separate informational and marketing text messaging programs. You may choose to receive informational messages, marketing messages, both types of messages, or neither.

Informational Text Messages

If you provide consent to receive informational text messages, Mindful Wellness may send you recurring messages related to:

  • Appointment confirmations
  • Appointment reminders
  • Scheduling and rescheduling updates
  • Care coordination
  • Service related notifications
  • Account and subscription updates
  • Renewal reminders
  • Responses to your questions or requests
  • Other administrative communications related to your relationship with Mindful Wellness

Marketing and Promotional Text Messages

If you separately provide consent to receive marketing text messages, Mindful Wellness may send you recurring messages related to:

  • Wellness program updates
  • New services and programs
  • Special offers and promotions
  • Patient feedback and review requests
  • Educational wellness information
  • Renewal and reengagement communications
  • Other marketing communications from Mindful Wellness

Consent to receive informational text messages does not automatically enroll you in marketing text messages. Marketing consent is requested and recorded separately.

2. How You Opt In

You may opt in by manually selecting an optional SMS consent checkbox on a Mindful Wellness website form, appointment request form, booking form, intake form, or another documented consent method offered by Mindful Wellness.

SMS consent checkboxes are unchecked by default. Providing your telephone number alone does not constitute consent to receive text messages.

Consent to receive text messages is voluntary and is not a condition of purchasing any product, receiving any service, scheduling an appointment, or completing a transaction with Mindful Wellness.

You must provide a valid mobile telephone number that you own or are authorized to use. Please notify Mindful Wellness if your mobile number changes or is transferred to another person.

3. Message Frequency

Message frequency varies based on your appointments, account activity, service usage, communication preferences, and the text messaging programs in which you enroll.

You may receive multiple informational messages related to an appointment, including confirmation, reminder, scheduling, and follow up messages. Marketing message frequency may also vary.

4. Message and Data Rates

Message and data rates may apply. Mindful Wellness does not charge a separate fee for participating in its text messaging programs, but your wireless carrier may charge you according to your mobile service plan.

You are responsible for any fees charged by your wireless carrier. Contact your wireless carrier for information about your messaging and data plan.

5. How to Opt Out

You may stop receiving text messages at any time by replying STOP to a message from Mindful Wellness.

You may also use another recognized opt out keyword supported by our messaging provider, such as CANCEL, END, QUIT, REVOKE, OPT OUT, or UNSUBSCRIBE.

After you submit an opt out request, you may receive one final confirmation message stating that you have been unsubscribed. No additional messages from the applicable SMS program will be sent unless you provide consent again.

Opting out of text messages does not cancel scheduled appointments, subscriptions, services, purchases, email communications, or other agreements you have with Mindful Wellness.

Informational and marketing consent may be recorded separately. Contact us if you want to stop only one category of text messages.

7. Message Delivery and Supported Carriers

Text message delivery is subject to effective transmission by your wireless carrier and our messaging service providers.

Carriers are not liable for delayed or undelivered messages. Mindful Wellness cannot guarantee that every message will be delivered or received within a specific period.

8. Healthcare and Sensitive Information

Text messaging may not be a secure or encrypted communication method. Do not send sensitive medical information, diagnoses, detailed treatment information, medication information, payment card information, passwords, or other confidential information through text message.

Automated messages from Mindful Wellness are generally limited to appointment, scheduling, account, service, and general wellness communications. We may direct you to a more secure communication channel when sensitive information is involved.

Text messaging is not intended for emergencies or urgent medical concerns. Do not send emergency requests by text message. Call 911 or seek immediate medical assistance in an emergency.

9. Your Responsibilities

You represent that you are the subscriber or customary user of the mobile number provided, or that you have permission from the subscriber to enroll that number.

If you no longer control an enrolled mobile number, you must promptly reply STOP or contact Mindful Wellness so the number can be removed from the messaging program.

You agree not to use the Mindful Wellness text messaging program for unlawful, fraudulent, threatening, abusive, or inappropriate communications.

10. Age Requirements

You must be at least 18 years old to independently enroll in a Mindful Wellness text messaging program.

A parent or legal guardian may provide consent for communications relating to a minor when legally authorized to do so.

11. Privacy

Information collected through the Mindful Wellness text messaging programs is handled according to our SMS Privacy Policy.

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.

Text messaging originator opt in data and consent will not be shared with third parties, except service providers necessary to operate and deliver the text messaging program.

12. Changes to the SMS Programs

Mindful Wellness may modify, suspend, or discontinue a text messaging program, message category, telephone number, or messaging provider at any time.

We may update these SMS Terms and Conditions from time to time. Updates will be published on this page with a revised Last Updated date.
