These Terms and Conditions govern your access to and use of the Mindful Wellness website, online forms, appointment and booking tools, communications, programs, products, and services. Mindful Wellness is referred to in these Terms as "Mindful Wellness," "we," "us," or "our."

By accessing our website, submitting information, requesting an appointment, purchasing a product or service, enrolling in a program, or otherwise interacting with Mindful Wellness, you agree to these Terms and Conditions. If you do not agree, do not use the website or services.

1. Eligibility

You must be legally able to enter into an agreement to use our website and services. Individuals under 18 may use services only with the involvement and authorization of a parent or legal guardian when required.

2. Healthcare and Medical Disclaimer

Website content is provided for general educational and informational purposes. It is not medical advice, diagnosis, treatment, or a substitute for consultation with a qualified healthcare professional.

Accessing the website, submitting a form, receiving marketing information, or communicating with Mindful Wellness does not by itself establish a patient-provider relationship. A patient-provider relationship is established only when the required intake, consent, evaluation, and acceptance processes have been completed.

Individual results vary. No information on the website guarantees that a treatment, medication, program, product, or service is appropriate, effective, or safe for every person.

3. Emergencies

Do not use the website, email, online forms, social media, or text messaging for emergencies or urgent medical concerns. Call 911 or seek immediate medical assistance in an emergency.

4. Appointments and Scheduling

Appointment requests are subject to availability, eligibility, confirmation, and any required intake or payment process. Submitting an appointment request does not guarantee that an appointment has been booked or that a service will be provided.

You are responsible for providing accurate contact, scheduling, and health information and for updating Mindful Wellness if information changes.

Cancellation, rescheduling, late arrival, and no-show requirements may be displayed during booking, included in a patient agreement, or communicated separately. You agree to follow the requirements that apply to your appointment or service.

5. Telehealth Services

Certain services may be provided through telehealth when permitted by law and clinically appropriate. Telehealth services may involve electronic communications, remote evaluation, technology platforms, and limitations that differ from in-person services.

Telehealth availability may depend on your physical location, provider licensing, clinical eligibility, technology access, and other legal or operational requirements. Additional telehealth consent forms or patient agreements may apply.

6. Treatment and Prescription Eligibility

Access to a consultation does not guarantee approval for treatment, medication, or a prescription. Treatment decisions are made by appropriately licensed healthcare professionals based on clinical judgment, medical history, applicable standards, and legal requirements.

Mindful Wellness may decline, discontinue, modify, or refer care when a service is not medically appropriate, required information is unavailable, legal requirements are not satisfied, or another provider or level of care is more appropriate.

7. Products, Programs, and Services

Descriptions, prices, availability, features, and eligibility requirements may change. We may correct errors, update information, limit quantities, discontinue offerings, or refuse a transaction when reasonably necessary.

Additional agreements, informed consents, program rules, subscription terms, refund terms, or patient documents may apply to particular products or services. If a specific agreement conflicts with these website Terms, the specific agreement controls for that product or service.

8. Payments and Billing

You agree to provide accurate and current billing information and authorize applicable charges for products, services, subscriptions, appointments, or programs you select.

Payments may be processed by third-party payment providers. Your use of a payment provider may also be subject to that provider's terms and privacy policy.

Fees, deposits, subscription terms, cancellation charges, refund eligibility, and payment schedules may be stated during checkout, booking, enrollment, or in a separate agreement. Except where required by law or stated otherwise in writing, payments are subject to the terms presented at the time of purchase.

9. User Responsibilities

You agree to:

  • Provide accurate, complete, and current information.
  • Use the website and services only for lawful purposes.
  • Protect the confidentiality of any account credentials.
  • Notify us of unauthorized account activity or incorrect information.
  • Follow instructions relating to appointments, treatment, medication, products, and services.
  • Use secure channels when asked to provide sensitive information.
  • Respect the rights, safety, privacy, and property of others.

10. Prohibited Uses

You may not:

  • Use the website or services for unlawful, fraudulent, abusive, threatening, or harmful purposes.
  • Submit false, misleading, or unauthorized information.
  • Attempt to gain unauthorized access to systems, accounts, records, or networks.
  • Introduce malware, harmful code, automated attacks, or disruptive technology.

You are responsible for keeping your email address, telephone number, and other contact details current.

12. SMS Terms

Mindful Wellness offers separate informational and marketing text messaging programs. You may choose to receive informational messages, marketing messages, both categories, or neither.

Informational Text Messages

If you provide informational SMS consent, messages may include:

  • Appointment confirmations and reminders
  • Scheduling and rescheduling updates
  • Care coordination
  • Account, subscription, renewal, and service notifications
  • Responses to questions or requests
  • Other administrative communications related to your relationship with Mindful Wellness

Marketing Text Messages

If you separately provide marketing SMS consent, messages may include:

  • Wellness program updates
  • New services and programs
  • Special offers and promotions
  • Educational wellness information
  • Feedback and review requests
  • Renewal, inactivity, and re-engagement communications

Informational consent does not automatically enroll you in marketing messages. Marketing consent is requested and recorded separately.

How You Opt In

You may opt in by manually selecting an optional SMS consent checkbox on a Mindful Wellness website form, appointment request form, booking form, intake form, or another documented consent method.

SMS consent checkboxes are unchecked by default. Providing a telephone number alone does not constitute consent. Consent is voluntary and is not a condition of purchasing a product, receiving a service, scheduling an appointment, or completing a transaction.

Message Frequency and Charges

Message frequency varies based on appointments, account activity, service usage, communication preferences, and the messaging programs in which you enroll. Message and data rates may apply. Your wireless carrier may charge according to your mobile plan.

How to Opt Out

Reply STOP to stop receiving messages. You may receive one final confirmation that your opt-out request was processed. Informational and marketing consent may be recorded separately. Contact Mindful Wellness if you want to stop only one category of messages.

Opting out of text messages does not cancel appointments, subscriptions, services, purchases, email communications, or other agreements.

Message Delivery

Message delivery is subject to your wireless carrier and messaging service providers. Carriers are not liable for delayed or undelivered messages. Mindful Wellness cannot guarantee that every message will be delivered within a particular period.

SMS Privacy

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with third parties, except service providers necessary to operate and deliver the text messaging program.

13. Privacy

Your use of the website and services is also governed by our Privacy Policy. Additional privacy notices, including a Notice of Privacy Practices, may apply to healthcare information.

14. Intellectual Property

The website and its content, including text, graphics, logos, photographs, videos, designs, software, trademarks, and other materials, are owned by Mindful Wellness or used with permission and are protected by applicable intellectual property laws.

You may view and use the website for personal, noncommercial purposes. You may not copy, modify, distribute, sell, license, publish, display, create derivative works from, or commercially use website content without prior written permission.

15. User Submissions, Feedback, and Reviews

If you submit feedback, comments, testimonials, reviews, photographs, or other content, you represent that you have the right to provide it and that it does not violate another person's rights or applicable law.

Mindful Wellness will not publicly use a patient testimonial, image, or health-related information without the authorization required by applicable law.

16. Third-Party Websites and Services

The website may link to third-party websites, social media platforms, scheduling services, payment processors, pharmacies, laboratories, review websites, or other services. Mindful Wellness does not control and is not responsible for third-party content, availability, security, products, services, terms, or privacy practices.

17. Website Availability and Changes

We may modify, suspend, restrict, or discontinue any part of the website or services at any time. We do not guarantee uninterrupted, error-free, secure, or continuously available access.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the website and general website content are provided on an "as is" and "as available" basis. Mindful Wellness disclaims warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in this section limits warranties, duties, or patient rights that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, Mindful Wellness and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from general website use, loss of data, loss of access, or reliance on general website content.

This limitation does not exclude liability that cannot lawfully be limited, including obligations that may arise from professional healthcare services, applicable patient rights, gross negligence, willful misconduct, or other non-waivable legal duties.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold Mindful Wellness harmless from claims, losses, liabilities, and expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person's rights, or submission of false or unauthorized information.

21. Governing Law

These Terms are governed by applicable federal law and the laws that apply to the Mindful Wellness entity, location, service, or transaction involved, without overriding any rights that cannot legally be waived.

Any dispute will be handled in a court or forum with lawful jurisdiction unless a separate written agreement provides another valid dispute process.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted or limited to the minimum extent necessary to make it enforceable when permitted by law.

23. No Waiver

A failure to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.

24. Entire Agreement

These Terms, together with the Privacy Policy and any applicable patient agreement, informed consent, payment terms, subscription terms, program rules, or other written agreement, form the agreement governing the relevant website use or service.

25. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised Last Updated date. Your continued use of the website after an update means you accept the revised Terms to the extent permitted by law.
